3PB’s 22-strong clinical negligence team offers specialist expertise across the full spectrum of clinical negligence claims and related areas, including litigation against surgeons and hospital physicians, general practitioners, dental surgeons, nurses and midwives, other healthcare specialists and in claims involving related issues of defective implants, and other medical devices and blood and organ products.
Clinical negligence barristers at 3PB provide advice and representation both to injured claimants and to defendant organisations in cases of varying degrees of complexity and size across a wide range of areas of medical practice such as orthopaedic, obstetrics and gynaecological, general and vascular surgery, cosmetic surgery, anaesthetics, emergency medicine and in general medical and dental practice.
Members of the team regularly undertake cases involving difficult issues of causation, including multiple contributory factors, missed diagnosis and loss of chance, and are also routinely sought out to undertake high value claims involving fatality or catastrophic injury with the related issues of funding substantial, long term treatment, care, equipment and accommodation requirements, periodical payments and the involvement of the Court of Protection.
Members are also regularly instructed to provide representation at inquests where clinical negligence is alleged. Members of the team act in disciplinary proceedings before regulatory bodies such as the GMC and NMC and members of chambers act as legal assessors to such tribunals.
Representation is offered in matters funded privately, by Legal Aid or CFA, and some members offer direct access to representation.
The Legal 500 UK Bar directory says: "3PB is recommended for personal injury and clinical negligence claims across the Western Circuit. Members have expertise in acting for children and individuals who lack capacity in clinical malpractice claims."
Chambers & Partners 2018 directory says: "Boasting a broad geographical spread with several centres across England, the set has a significant presence on the Western Circuit. Members regularly act for a variety of claimants, with vast experience representing bereaved families in inquests and court proceedings arising out of fatal accidents. Areas of focus include complex catastrophic injury, surgical error and delayed diagnosis and misdiagnosis of cancer cases. The chambers is especially noted for its adeptness at advising on consent issues. One instructing solicitor likes the fact that the barristers "are all very accessible, get back to you very quickly and provide very comprehensive written opinions on the particulars of a claim in a way that can be understood.
"The clerks are good fun to deal with, but when they say they will do something they will. They are very easy to get hold of and approachable." "The clerks are really helpful, and happy to arrange a barrister for you if the one you request isn't available."
