School admissions and exclusions

3PB barristers have an exceptional success rate as counsel in appeals concerning school admissions (including nursery and infant class admissions) before an Independent Appeal Panel,  acting for both parents and schools alike.

3PB has a longstanding reputation as the chambers for SEN matters and making successful admission appeals. These may save parents from funding expensive independent school fees and come as school admissions appeals are rising significantly at primary and secondary school level, for all types of schools. Failure to allocate a place to a child/young person who has a Statement of Special Educational Needs or EHC Plan will be brought in the First Tier Tribunal (Special Educational Needs and Disability) in Darlington and not before an Independent Appeal Panel. While this is a different type of Appeal and process, 3PB has the most highly respected team of counsel for this type of appeal. 3PB also routinely act as counsel at infant class size appeals, In-year appeals and secondary school appeals.

3PB’s specialist barristers frequently deal with complex and routine school exclusion cases, considering pupil disciplinary matters and school/parent relationship. The set has advised on a number of school attendance prosecutions, including family holiday cases.
