Nicola Martin (formerly Nicola Simpson) specialises in all aspects of Family Law and Practice. Nicola has particular experience in Children Law, both public and private, acting for local authorities, mothers, fathers, Childrens’ Guardians and other family members such as Grandparents and step-parents. Many of her cases have involved allegations of sexual, physical or emotional abuse of children arising out of alcohol/substance abuse, domestic violence, mental health/depression, Munchausen Syndrome By Proxy, poor cognitive ability etc.

Main other areas of Children Law covered are Adoption, Financial provision for Children under Children Act 1989 schedule 1 and Child Abduction (reported case: Re B (Child Abduction : Habitual Residence) [1994] 2 FLR 915).

Her experience in Matrimonial matters extends to Divorce, Nullity, foreign decrees and Ancillary Relief (including financial injunctions. In addition she undertakes cases under the Trusts of Land and Appointment of Trustees Act, Inheritance (Provision for Family and Dependants ) Act 1975 and Family Law Act 1996 (injunctions etc.) for applicants and respondents and issues arising from Proceeds of Crime legislation (see specialist profile).

Nicola appeared on behalf of the Appellant in the Privy Council case Abbott v Abbott (2007) in relation to beneficial ownership of property. She has also acted on behalf of appellants in the Criminal Injuries Compensation Appeals Tribunal in cases arising out of sexual abuse.

She has been a member of the Family Law Bar Association and Western Circuit since 1982.
