Alternative Dispute Resolution (ADR) in civil cases and Non-Court Dispute resolution (NCDR) in family cases are a collection of processes used for the purpose of resolving conflict or disputes informally and confidentially, away from the court process.

Members of 3PB are also regularly appointed to act as independent Arbitrators (either alone or as chairs or members of arbitral panels), Adjudicators, Mediators, Private FDR Judges and instructed to sit on Dispute Resolution Boards (DRB’s) across our core areas of practice and also chosen to provide independent expert determination or conduct expert internal investigations. This includes matters in commercial litigation, insurance and reinsurance, employment, personal injury, clinical negligence, and family law.

3PB's ADR specialists include former High Court Judges (Family Court) and senior members of chambers, dual-qualified chartered surveyors, civil engineers, and chartered architects. 3PB have one of the largest team of neutrals and arbitrators at the Bar, and all our arbitrators are qualified as members of CIArb and other relevant organisations like IFLA (family) and FIDIC (construction).

Arbitration: used in construction, commercial, employment and other civil cases and family disputes.  In arbitration, the parties choose their judge and agree to be bound by his or her award. There are many benefits of arbitration including speed, confidentiality and the ability to agree who will be the judge. Our barristers are routinely instructed to appear as arbitrators and  as advocates at the arbitration: it is very familiar casework for 3PB.

Mediation: used in all types of disputes including family finance and children's cases, civil and commercial, property and employment. 3PB have many fully trained, expert mediators in Chambers who bring their knowledge and expertise to bear as the parties, with the help of a mediator, can find a bespoke solution to their particular case which can then be turned into a legally binding court order. 3PB can represent you at the mediation or sit as the mediator. Benefits of mediation include speed, cost, confidentiality and avoiding acrimony.

Early Neutral Evaluation (ENE): used in any case where you want to get an idea of how a judge will look at the case, normally as part of a joint process.

Private Financial Dispute Resolution (FDR): is a specialist form of evaluation in family finances. An experienced barrister listens to the parties' positions and provides an indication as to how a judge is likely to decide the case in order to assist the parties negotiate an agreed resolution - and give their opinion on a neutral and impartial basis. The advantage is you can choose your judge and cases are heard quicker with better flexibility on location and format. The costs of delay and/or there being "no available judge" can be avoided.

Private Settlement Conference / Pre-trial Settlement Hearing (PTSH): a specialist form of evaluation in civil matters.
