Overview

Civil law barrister Jamie Johnston joined 3PB in April 2022, transferring from a chambers in Newcastle and returning to work in Birmingham. He specialises in property and chancery, commercial disputes and disciplinary/regulatory work (including sports) and has a busy practice in the High Court, County Court, tribunals and hearings.

Before coming to the Bar, Jamie spent ten years' building up and then selling a national franchising company so brings significant commercial pragmatism, robust negotiation skills and business acumen to his legal practice.

When not working as a barrister, Jamie maintains his love of sport and continues to train and compete in running and duathlon events at a national and international level, and will be competing in this year's World and European Championships 2022.

    Jamie Johnston is a property barrister who combines real-world experience with his legal knowledge and a forensic attention to detail. He appears frequently in multi-track and fast track cases in the Business and Property Court lists and civil lists. Solicitors repeatedly instruct him to advise and represent clients in boundary disputes, planning disputes, easements and adverse possession claims.

    Jamie manages a portfolio of residential property so has a first-hand appreciation of landlord’s concerns. He is frequently instructed by landlords in residential and commercial cases for possession and forfeiture. He has substantial experience in deploying estoppel and equitable rights arguments on behalf of tenants. Jamie acts in a range of TOLATA claims.

    • Represented clients in a variety of boundary disputes including residential and non-residential cases
    • Advised a commercial developer on their rights of access, impact of restrictive covenants and a potential ransom strip for a proposed new development
    • Advised on several cases concerning planning permission and the prospects of challenge by Judicial Review
    • Advised on restrictive covenants and prescriptive easements
    • Drafted pleadings and represented clients in trespass and possession cases

    As a commercial barrister Jamie’s business understanding resonates well with business clients who see in him a kindred spirit. As a long-time managing director he has first-hand experience of managing employees and franchisees, commercial negotiations and resolving customer complaints. This gives him a unique understanding of the competing commercial considerations of business clients.

    His reputation as a ‘business-person’s barrister’ sees him instructed and re-instructed in a wide range of disputes including debt recovery, contractual breaches, agency contracts and faulty goods. He has secured and defended applications for freezing injunctions in a variety of cases.

    Recent work:

    • Jamie has a rapidly growing reputation in secret commission cases following his successful appeal against allocation to the small claims track in the reported case of Elias v Blemain Finance. He has conducted many trials and allocation hearings in the past few months.
    •  He obtained judgment following trial in litigation lasting three years concerning a commercial debt. This long-running dispute required successfully obtaining freezing injunctions against two parties and winning a preliminary issue trial.
    • Jamie has advised on and represented clients in a number of cases Consumer Rights Act 2015 cases concerning prestige cars with inherent defects
    • Jamie recently acted for a commercial hire company in a claim against a commercial developer

    Jamie has recently acted in and advised upon a range of professional negligence claims concerning conveyancing errors and the drafting of wills as well as cases concerning:

    Jamie Johnston has used his extensive experience in elite sport to build a burgeoning sports law practice.  A former professional coach, he has over 20 years’ experience working with athletes from every level from grassroots to international and junior international competition. He has trained both able-bodied and para-sport athletes. Jamie himself competed in hockey and cross-country running at national level and now represents GB at age-group level in duathlon, and will be competing at the 2022 World and European Championships.

    Jamie is appointed to the British Cycling and British Canoeing disciplinary panels, chairing tribunals adjudicating on athlete offences. He was also legal adviser to the organisers of the 2018 national road cycling championships.

    Recent work includes:

    • A lengthy local government misconduct matter with consideration of the Localism Act 2011 and Nolan Principles

    Barrister Jamie Johnston represents local councillors in disciplinary procedures concerning serious allegations such as malfeasance, financial mismanagement or discrimination. He is familiar with the interplay and interpretation of the Localism Act 2011, Nolan Principles and principles of natural justice in investigations and hearings.

    Jamie provides pragmatic guidance with robust representation at all stages of disciplinary proceedings. He is adept at identifying failings in the investigative process and advises clients how to challenge them.
