Family law team acts in two reported cases

This quarter, our team has acted in two reported cases, both involving Dorian Day.

The first is Local Authority -v- Mother (1) Father (2) Lucy (By Her Children’s Guardian) and Belinda [2020] EWHC 2801 (Fam), a complex case considering where Lucy should be placed following on from a lengthy and difficult finding of fact hearing. Dorian DayDorian DayCall: 1987 represented Belinda, Lucy’s older sister who was successful in arguing that Lucy should be placed with her alongside a package of support, in opposition to the local authority’s care plan. The second reported case is Re Y (Children in Care: Change of Nationality) [2020] EWCA Civ 1038, which involved Dorian Day and Matiss KruminsMatiss KruminsCall: 2008. An interesting case before the Court of Appeal which raises the question of whether a local authority has the statutory power to take steps to change the nationality of a child in its care against the wishes of the child's parents, or whether it must first seek the approval of the court.
