Victoria Hamblen offers commentary on recent CoA case relating to the scope of HS2 Planning Permission

Victoria Hamblen, specialist property and estates barrister at 3PB Barristers (3 Paper Buildings), has written on the recent case of R (North Warwickshire Borough Council) v Secretary of State for Transport [2026] EWCA Civ 832, which involved a change to part of the design of the HS2 plans.
The appeal, which related to a proposed 2.9km extension to the Bromford Tunnel which did not form part of the original planning permission, sought to identify whether the judge in the original case misconstrued a section in the The High Speed Rail (London-West Midlands) Act 2017 which enabled the developer to deviate from the approved plans and carry out “non-scheduled works” outside those set out in the Act.
