Mark Green appears in Court of Appeal on two separate appeals, including on an important case about limitation and time limits

On 25 July Mark Green appeared in the Court of Appeal on two separate appeals, led by Timothy Brennan QC.

The first appeal looked at when the 6 year limitation deadline imposed by the Limitation Act 1980 would apply in the context of an unlawful deduction of wages claim for sums owing under the national minimum wage legislation over a period of 15 years.

The second case involved a question of the time limit to appeal a liability judgment that considered the applicability of the national minimum wage to ‘sleep-in shifts’.

The importance of the appeal was reflected in its selection for the Court of Appeal’s live streaming service on its YouTube channel.

Judgment was reserved and an update will be provided upon its handing down. The main EAT judgment was Coletta v Bath Hill Court (Bournemouth) Property Management Ltd [2018] ICR 1373.
