3PB’s property barrister, Joshua DubinJoshua DubinCall: 1997, has written an article entitled 'Mowing the grass: is it sufficient for adverse possession?' in which he discusses a recent case where he acted for a homeowner when the possession of a grass verge between two properties on an open-aspect estate was called into question.

Joshua's clients had been caring for the grass verge since they moved into the property in 1983. In late 2016, the neighbours began to construct an extension, using the verge for access and compacting the soil on it, so they re-turfed it when construction was finished.

Within his article, Joshua discusses both the outcome of this case, as well as other recent cases involving similar circumstances of adverse possession, to offer practitioners useful guidance on how best to approach cases where the principal act of possession on an open space is the mowing of grass.
