Overview

Sam is a family barrister specialising in financial remedies and private children matters. Prior to joining the bar, he held positions in a variety of roles in commerce and industry, latterly as a policy adviser on sustainability and environmental regulation for the manufacturing sector.

Sam brings commercial awareness and pragmatism to his family finance practice and is skilled at representing litigants where there is a family business or complex trusts issue.

He has a growing specialism in matters relating to Trusts of Land and Appointment of Trustees 1996 (Tolata) claims, particularly where there is a chancery or commercial crossover and additional causes of action such as conversion and unjust enrichment.

In private child work, Sam is resolution focussed and practical but also a robust advocate when the matter requires it. His specialism as a children practitioner extends to the often-complex field of international relocation at High Court level. He appeared for the respondent in the reported case of Z v X (Visit to Ukraine) [2024] EWHC 314 (Fam) before Cobb J.

Financial Remedies and ToLATA

Sam is experienced at guiding litigants through the financial remedies process from First Appointment and FDR to Final Hearing. He regularly provides early advice and drafts pleadings in ToLATA applications and is happy to have strategic discussions in advance of an application being made.

Sam regularly deals with the following issues at all stages of proceedings:

Significant cases:

C v C – represented the applicant from first appointment to final hearing. Significant foreign trust issue requiring expert evidence and challenge at Final Hearing.
B v B – represented the respondent in financial remedy proceedings involving allegations of hidden assets and fraudulent trust deeds.
A v A - represented the intervenors in complex financial remedy proceedings. Involved the intervenors interest in various properties said to belong to the parties. Ultimately heard in the High Court.
R v R – represented the applicant from first appointment to private FDR. Multi-million asset base including complex pension instrument requiring expert evidence.
A v A – represented the applicant in an application to enforce and set aside a consent order. Involved the issue of non-executory pension sharing orders, Barder and Thwaite jurisdictions.
D v A – early advice and pleadings in a complex Tolata matter involving alternative causes of action and engaging section 17 of the Married Womens Property Act 1882.
