Victoria Jones acted for Google LLC, a respondent to an appeal brought by Shorts International Ltd against Google's successful opposition to its application to register “SHORTIE” as a trade mark. In the appeal to the appointed person, the original decision of the hearing officer was upheld with the appointed person finding that the hearing officer had not erred in refusing registration of the trade mark “SHORTIE” for “downloadable electronic data files featuring audio and video” in Class 9  on the basis that it was descriptive and non-distinctive. In so doing, the hearing officer had applied the correct test for descriptiveness.
