Disabled children’s social care reform: Liz Adams on the Law Commission’s final report

Liz Adams, education and family law barrister at 3PB Barristers (3 Paper Buildings), has published a new article in the February edition of the Family Law Journal titled “Disabled Children’s Social Care: Final Report.”

In the article, Liz provides an in-depth analysis of the Law Commission’s first major review of disabled children’s social care over three decades.

She examines three key areas of legal significance, first being the introduction of new statutory principles governing disabled children’s social care. Then the greater alignment with the SEND legal framework and the appropriate mechanism for determining the capacity of disabled children under 16 to make decisions about their own care.

Liz also outlines the key proposals that may have the most immediate and noticeable impact for families and local authorities, followed by a consideration of the next steps that must happen to turn the report into meaningful reform.
