Overview

Amy Lush has a keen interest in all aspects of family law. As a tenant, Amy has been quick to gain experience advising and representing individuals in a wide range of family cases, including, financial disputes under the Matrimonial Causes Act 1973 and Trusts of Land and Appointment of Trustees Act 1996; public law children proceedings; private law children proceedings including applications for enforcement and variation of Child Arrangements Orders; and Non-Molestation and Occupation Orders. She regularly acts for Applicants and Respondents from First Hearings through to Finals Hearings.

She is also experienced in property advocacy and is regularly instructed on behalf of landlords, tenants, social housing providers and Local Authorities.

Amy is a qualified collaboration lawyer with Resolution and is a member of the Solent Collaboration Group (POD). She is qualified to accept instructions directly from members of the public and professional clients under the Direct Public Access scheme, or assist with ongoing matters.

    Private law children

    Amy regularly acts for Applicants and Respondents, including Rule 16.4 Children’s Guardians and grandparents, in all aspects of private law children proceedings. She is experienced in representing parties involving:

    • Cases of implacable hostility/ intractable disputes
    • Domestic violence
    • Mental health
    • Substance misuse including prescription and illegal drugs and abuse of alcohol
    • Repeat offending
    • Relocation, both within the UK and outside the jurisdiction
    • Temporary removal from the jurisdiction

    Public law children

    Amy regularly acts for Local Authorities, parents, family members and Children’s Guardians. She is experienced representing parties involving:

    • Applications for Section 38(6) assessment
    • Parents with special educational needs and issues of cognitive impairment and capacity
    • Domestic violence
    • Repeat offending
    • Chronic neglect
    • Substance misuse, including prescription and illegal drugs and abuse of alcohol
    • Mental health
    • Adoption
    • Special Guardianship and kinship placements
    • Applications to discharge Care Orders/ Special Guardianship Orders

    Financial Remedy

    Amy regularly acts for Applicants and Respondents in cases involving financial remedies on divorce from First Directions Appointments through to Final Hearings. She is experienced representing and advising parties involving:

    • Inherited wealth
    • Non-matrimonial assets, including pre- and post- acquired assets
    • Applications to vary and enforce

    Further, Amy is experienced advising and representing individuals in relation to applications under the Trusts of Land and Appointment of Trustees Act 1996 and Schedule 1 of the Children Act 1989.

    Amy is regularly instructed on behalf of landlords, tenants, social housing providers and Local Authorities. She has gained a wealth of experience in Landlord & Tenant and Housing Law matters and is experienced representing parties involving:

    • Disrepairs and landlords’ repairing obligations
