Construction and engineering

Alice Horn is a barrister who is developing a good practice in construction disputes, and associated professional liability matters, and their arbitration. Alice's expertise developed whilst working as a Judicial Assistant in the Technology and Construction Court (TCC) with Mrs Justice Jefford and Mr Justice Waksman, who is its Judge in Charge.

Working at the TCC, Alice assisted on a range of international and UK cases including technology, procurement, construction, and contract-based cases, as well as injunctions, CCMCs, and issues arising out of, or in connection with arbitral proceedings, by conducting legal research, drafting, or preparing summaries and case notes.

During pupillage, Alice was involved in Providence Building Services Limited v Hexagon Housing Association Limited, a case on the interpretation of termination rights under clause 8.9.3 of the 2016 edition of the JCT Design and Build Contract. The Supreme Court is due to issue judgment on that matter on 15 January 2026.

Alice now frequently appears in County Courts and High Courts at all stages of litigation proceedings in addition to maintaining a busy advisory and drafting practice. She can be instructed in a wide variety of construction-related cases, including:

  • Adjudication proceedings
  • Arbitrations (both domestic and international)
  • Breach of contract and counterclaims for payment
  • Building Safety Act 2022 claims and Building Act 1984 disputes
  • Commercial lease disputes over construction works
  • Contractor disputes in residential and commercial buildings
  • Defective Premises Act 1972 claims
  • Enforcement matters
  • Engineering disputes
  • JCT contract claims, including non-payment of retention sums
  • NHBC Guarantees and builder warranty breaches
