Katherine Anderson, an education law specialist and barrister at 3PB Barristers (3 Paper Buildings), ranked as a Leading Junior by Chambers and Partners and Legal 500, has published a second edition of her successful book ‘A Practical Guide to Education, Health and Care Plan Appeals in England’.
This book examines the relevant statutory framework and case law, alongside the rules and procedures of the First-tier Tribunal and Upper Tribunal governing these appeals.
More than 1.7 million pupils in England have special educational needs (SEN), with over 480,000 supported by Education, Health and Care (EHC) plans. Except for 2020, requests for EHC plans have increased every year since their introduction. In the 2023/24 academic year, HMCTS recorded 21,000 registered SEN appeals, an increase of 55% on the previous year.
These appeals concern disputes in England between local authorities and parents or young people regarding EHC needs assessments and EHC plans. Their scope has expanded to include health and social care issues. Hearings take place in private before independent panels comprising a judge and specialist members and the examination of expert evidence is a central feature of the tribunal process.
