Family Law Education: a short case study on the Hague Convention

Stephen Wildblood KC writes and directs a short film, lasting 5 ½ minutes, telling the story of a mother (Angie) who has retained two children (James [12] and Martha [4]) in New York against the wishes of their English father, Zac. Angie has been in New York with the children for two months and wishes to remain there with them. Zac wants them all to return to London, where they had been living as a family.
The film, performed by Fractured Voices theatre group, can be viewed below. It raises interesting points for family law practitioners to consider, including the following:
- Which Articles of the Hague Convention are engaged?
- Would Angie be forced to return the children?
- What would happen in the UK if she were forced to do so? Would she be allowed to return to New York with them and, if so, on what terms?
- What would happen if Zac and Angie agreed that Angie and the children should spend four months in Calgary (Canada) with the uncle and, four months later, Zac tried to force the children’s return to the UK under the Convention?
