Overview

Febienne Green is a specialist personal injury and clinical negligence barrister who has completed her pupillage with a specialist personal injury and costs advocacy team at a well-known law firm. Febienne's expertise already exceeds her peers as she has undertaken more complex trial and advisory work from the outset.

Febienne joined 3PB as a probationary tenant in October 2025 and is working from 3PB's new Manchester office. She lives in Cheshire and has already worked in Manchester for many years.

During pupillage, Febienne built up an excellent personal injury practice and was, unusually, regularly instructed for fast-track hearings including where fundamental dishonesty has been alleged. She was also frequently instructed in disposal hearings, Stage-3 hearings, case management conferences, costs hearings, interlocutory hearings, and attended numerous professional and client conferences.

In her first six months of pupillage, Febienne was regularly instructed in interlocutory hearings, including case management conferences, pre-action disclosure, infant-approval, deductions, wasted costs and relief from sanctions hearings. She also attended applications to amend statements of case, set aside default judgment, stay a claim, rely on further medical evidence and to strike out.

A former law firm clinical negligence paralegal, Febienne assisted on birth injury cases, including attending JSMs and conferences of multidisciplinary experts. She completed medical record reviews, research and drafted witness statements, a quantum advice and schedule of loss. She did her dissertation in LLM in 2022 on disability discrimination in medical law, with a focus on Down Syndrome cases.

Febienne has developed a strong advisory practice, drafting advices on prospects, quantum, advising on fundamental dishonesty risks, schedule of loss, particulars of claim and court orders.

Throughout her pupillage, Febienne has garnered excellent feedback as a barrister with excellent client care skills and meticulous preparation, resulting in favourable outcomes for professional and lay clients alike; and being repeatedly instructed by the same solicitors. She has also been praised for her integrity, dedication and unwavering drive to make a positive difference in the lives of others.

Outside busy work demands, Febienne enjoys running, yoga and adores music, attending the theatre whenever she can.

    Febienne Green is a barrister specialising in personal injury and costs cases.

    During the first six months of pupillage, she was instructed on interlocutory hearings, including costs, infant approval and relief from sanctions hearings, as well as case management conferences. Febienne developed her advocacy ability and an understanding of civil practice, whilst demonstrating her ability to acquire knowledge and adapt quickly. During this time, She also shadowed her pupil supervisors and senior members of the team in fast-track trials, conferences and some interlocutory hearings.

    During her final six months of pupillage, Febienne was instructed on interlocutory hearings and fast-track trials, including where fundamental dishonesty was alleged in all personal injury cases, such as employers’, occupiers and public liability as well as road traffic accidents.

    She also ran professional conferences with instructing solicitors and client conferences to address prospects and quantum assessments. She balanced this court work with a strong paperwork practice, in drafting advices on prospects, quantum, the risks of fundamental dishonesty and particulars of claim, schedule of loss and court orders.

    Recent cases include:

    RH v A company: established in cross-examination of the defendant witness that the claimant had followed his training, until just after his injury, utilising CCTV footage and timeframes established in the defendant’s interview records. This  proved the claimant’s case and defeated the defendant’s contributory negligence arguments.

    MH v A company: persuaded the judge in closing submissions to limit contributory negligence to 5% in an employers’ liability case, where the claimant injured his back whilst independently hoisting a service user who was known to require 2-to-1 care when being lifted.

    PR v A company: persuaded the judge in an interlocutory hearing to attach a penal notice to a pre-action disclosure order against a Litigant-in-Person who was previously the CEO of the defendant company, utilising case law. The hearing had been adjourned twice before and Febienne secured costs reserved in the second hearing, which resulted in a costs order for all three hearings.

    Febienne Green is a clinical negligence specialist counsel, having worked as a clinical negligence paralegal within the ‘birth injury’ team at a specialist law firm; assisting on birth injury cases, including attending JSMs and conferences of multidisciplinary experts. This has given her valuable insight into clinical negligence disputes.

    Febienne completed medical record reviews, research and drafted witness statements, a quantum advice and schedule of loss. She also did her dissertation in her LLM in 2021 on disability discrimination in medical law.

    Febienne intends to develop her clinical negligence expertise over the coming years and is inspired by a personal family tragedy, after witnessing the impact of a clinical negligence dispute involving a close family member. Due to a clinician's misdiagnosis, they suffered a brain injury that resulted in severe disabilities. She witnessed the positive impact of the representation and powerful advocacy on their behalf and its outcome and in her family, feeling heard during the process. She intends to provide the same representation to her clients.
