Mark Lomas successful in multi-jurisdiction spinal cord injury case

3PB Barristers’ (3 Paper Buildings) specialist personal injury and clinical negligence barrister Mark Lomas has been successful for a man who was severely injured by a falling tree during a domestic tree-felling incident in the Channel Islands. Mark worked alongside James Braund of Trethowans and George Pearce of BCR Law.
The client, Mr X, sustained catastrophic injuries while assisting with the removal of a tree at a private property in the Channel Islands. During the work, the tree – which had been tied to the property owner’s vehicle – fell on Mr X, causing multiple fractures and a spinal cord injury at the T6/T7 level, which left him permanently paraplegic.
Following extensive discussions and negotiations with the defendant homeowner’s motor insurance company, and the input of a number of experts, a mutually-acceptable monetary offer was agreed upon to settle the claim.
Speaking about the case, Mark said: This claim gave rise to a number of interesting issues of law - but by working across the jurisdictions and drawing upon the combined experience of the legal team to maintain a determined and consistent approach to the litigation throughout, it was possible to secure a successful outcome.”
