Overview

Scott Sharp is a busy family barrister who is frequently instructed in a range of UK and international private law children, divorce and other family financial disputes including TOLATA (Trusts of Land and Appointment of Trustees Act) and Court of Protection cases.

Scott will be joining 3PB later in October 2025 and will be based from 3PB's London office.

Scott understands the various levels of the legal profession which enables him to advise both lay and professional clients to a very high standard. Scott prides himself on being approachable, down-to-earth and realistic, accommodating to his clients' personal needs, whilst being able to provide firm and robust advice, where needed, and giving realistic counsel that best assists those instructing him.

Scott provides several seminars to solicitor clients and family law networks such as Resolution and is a frequent author in family law publications. He has been a host of the Family Law Week Podcast advising on children and financial disputes and recent cases.

    Public Law Children (Care)

    Scott is regularly instructed to act for parents at all stages of Public Law Children proceedings. Scott is highly understanding that such proceedings can be extremely stressful and emotive for parents, and he is versatile in adapting to the specific needs of parents whilst providing robust and clear advice.

    Scott has been instructed on a number of matters for parents with cognitive difficulties and has developed numerous techniques in client handling to enable them to be fully informed and engaged within proceedings.

    Child Arrangements (Private Law)

    Scott is also frequently instructed to represent parties in a range of Child Arrangement proceedings, ranging from non-molestation and occupation orders, to child arrangement disputes inclusive of change of residency and arguments relating to jurisdiction.

    Internationally, Scott is currently representing a left-behind parent in the High Court, following the illegal retention of her five children in Belgium. Despite having previously obtained declarations in the High Court that the actions of the other parent amounted to international child abduction, and with concurrent 1980 Hague Convention proceedings in Belgium, which have ordered the return of the children, Scott continues the fight for their practical return to their mother.

    Frequently, the cases involve allegations of domestic abuse of both historic and modern allegations.

    Financial Remedies

    Scott advises and represents clients at all stages within Financial Remedy Proceedings, and in particular he receives instruction in needs-based cases which include spousal maintenance and applications for variation.

    He has developed a specialism in financial remedies work where there are economic abuse arguments in the dispute. This has seen him persuading a trustee for bankruptcy to stop an immediate order for a house sale and to increase the equity his client would eventually receive from the sale of the family home.

    TOLATA disputes

    Scott has excellent experience in dealing with disputes between former co-habitants in Trusts of Land and Appointment of Trustees Act 1996 cases (TOLATA) and undertakes the drafting of applications and well as representing clients at court.

    Scott Sharp is developing a good and frequent Court of Protection caseload.

    He has an excellent reputation for being able to manage and assist vulnerable clients well. Scott sits on the Bar Council's Disability Panel and draws on his own experiences of growing up with, and still having, a significant disability.

    His understanding and empathic approach to individuals when they need support aligns also with the ethos and principles of Court of Protection work.
