Mark Wilden appearing in Competition Appeal Tribunal in case involving Microsoft software resale

3PB’s specialist intellectual property barrister Mark Wilden is currently appearing in the Competition Appeal Tribunal in a case involving the legality of selling pre-owned Office and Windows software.
The two-day hearing, running from 9-10 September 2025, looks to resolve the key question of whether certain components of Windows and Office fall outside the EU’s copyright exhaustion rules for software, which allows the resale of perpetual software licenses. This important decision could significantly effect the legal foundation for the software resale markets in the UK and across Europe.
