Holly Fagan’s client acquitted of two charges of harassment with fear of violence

3PB Barristers’ specialist criminal law barrister, Holly FaganHolly FaganCall: 2021, has secured acquittals for her client, accused of harassing two people causing them to fear violence.

Holly’s young client, A, heard that the first Complainant (C1) was spreading rumours about him and confronted her in a night club. This did not achieve anything so he tried to speak to her father (C2), who he knew, in the hope that he could help them resolve the situation. The allegations were that A had threatened C1 and assaulted C2 outside the night club, sent threatening text messages, made numerous calls and attended their home address twice.

The case required gentle but focussed cross-examination to highlight inconsistencies in the Complainants’ accounts, as well as effective use of CCTV which cast events in a different light.

Holly’s handling of the case enabled the jury to understand A’s perspective and intentions. After a 3-day trial at Bournemouth Crown Court, Holly’s client was acquitted of both counts.
