Planning

Our planning team recognize the wide diversity central government has placed on local planning authorities.  The responsibilities and obligations which have developed over recent years, and the impact they have had on local planning and development opportunities.   We work with our clients at every stage of the planning process from  application, to appeals, to inquiry.  As well sensitive matters where there are issues arising out of the exercise of discretion.

Our barristers are regularly instructed to act on behalf of developers, local planning authorities and interested parties, working as a team to ensure the process is as effiecent and effective as possible.   In addition to this our team offer extensive experience of both prosecuting and defending enforcement matters.

Similarly, all aspects of work are undertaken with regard to the EPA 1990 and related legislation including the Contaminated Land Regime and Waste Disposal matters generally. Recent planning inquiries undertaken by members of the team have raised planning issues concerning:

  • Green Belts and conservation
  • Assets of community value
  • Village Green
  • Trees (TPO’s)
  • Affordable Housing
  • CLEUDs
  • Advertisements
  • Various alleged material changes of lawful use
  • Unlawful fly-tipping

The work undertaken by Members of this team includes instructions from the Overseas Territories Governments, and encompasses all levels of Tribunal and Courts through to the ECJ as well as those matters where ADR is appropriate.

The Legal 500 UK Bar directory says: "The team at 3PB has expertise across a range of construction, planning and environmental matters. Members continue to be active in village green applications and appeals."
