Employment and discrimination

Faizul Azman acts for both claimants and respondents and accepts instructions in all areas of employment law.  His previous experiences in holding senior management positions in a variety of roles provide him with an in-depth understanding of HR and workplace matters, particularly public and quasi-public bodies like local authorities, government departments, HM Armed Forces, police and fire authorities, government agencies and  universities/colleges/schools.

Faizul is a barrister regularly instructed in a number of employment matters both nationwide in the UK and internationally.  His recent work includes:

  • Conducting pre-action disclosure for an international organisation in response to a constructive unfair dismissal of a CEO worth US$5m;
  • Unpaid holiday pay where a claimant accrued holiday pay whilst on long term sick leave having only worked for 9 weeks;
  • A remedy hearing where an employer went into liquidation during proceedings, and advising the claimant on what could be claimed through the National Insurance Fund;
  • Contractual claims;
  • All forms of discrimination under the Equality Act 2010.

    SMO v Hywel Dda University Health Board [2020] EWHC 727 (QB)
    The Court found in favour of the claimant, a consultant surgeon, to restrain the defendant from continuing a working relationships investigation into his alleged conduct, competence or behaviour, whilst carrying out disciplinary proceedings in parallel.
