Elaine has extensive experience in cases involving all kinds of personal injury matters which may involve Clinical Negligence, Employers Liability, Public Liability, RTA's, Credit Hire and Industrial Disease.
Elaine has a particular interest in Clinical Negligence. Recent instructions include claims ranging from medical negligence resulting in patient death to diagnostic failures in cancer screening. Such cases invariably require consideration of complex legal issues, analysis of voluminous medical records, and demand effective advisory and drafting skills.
Astute case management is fundamental to achieving good outcomes in Clinical Negligence claims. Sensitivity to client care is essential. Clinical negligence cases in relation to which Elaine has advised and/or drafted pleadings, have always been resolved with a positive conclusion for the lay client.
In addition to her civil practice, Elaine accepts instructions to attend Inquest hearings and has gained considerable experience in this field. Her attendances at the Coroner's Court have involved:
- Article 2 inquest hearings involving death in custody and suicide
- Road traffic inquests (on behalf of both insurer and family)
- Pre-inquest review meetings
- Drafting of submissions in relation to Prevention of Future Deaths Report
- Drafting of Questions to Inquest Jury.
The investigations often demand analysis of complex medical issues and voluminous documentation, with numerous Interested Parties in attendance. Elaine is ever diligent in representing the interests of her client and tirelessly supports the fact finding exercise.
However inquest proceedings require particular sensitivity and care; the family of the deceased are suffering the loss of a loved one. Experience has proved invaluable in handling such difficult cases.
