Public Law & Regulatory

Tom has a diverse and wide ranging public and regulatory law practice that spans both civil and criminal jurisdictions. In July 2009 he was appointed to the Attorney-General’s Unified List of Prosecuting Advocates (Panel C).

In the field of trading standards Tom has prosecuted and defended in cases brought under the Trade Descriptions and Trade Marks acts and in a number of cases involving allegations of defective building works.  He has also recently represented a well known building firm facing committal proceedings as a result of alleged breaches of a civil injunction.

Tom also has considerable experience of animal welfare prosecutions, including defending both farmers and producers facing prosecution under the Animal Welfare Act and prosecuting for local authorities under that act and the Dangerous Dogs Act.

In the field of Food Safety, Tom was recently instructed to prosecute the UK’s largest food producer, Premier Foods, in respect of offences contrary to the Food Hygiene  Regulations 2006. The case involved consideration of the ‘hazard analysis and critical control point’ (HACCP) principles and received widespread media attention. Tom has also defended in HSE prosecutions and in this area draws upon his experience in personal injury law where he is often instructed in accident at work cases.

As the holder of a Private Pilot’s License Tom has a keen interest in all things aviation and prosecutes aviation offences for the Civil Aviation Authority. He is also regularly instructed in licensing matters (recently appearing in Cherwell DC v Anwar [2011] EWHC 2943 (Admin)) and licensing prosecutions and has appeared for Fire Authorities in appeals against fire enforcement notices.
Tom is also regularly instructed by both Police forces and claimant’s in actions against the Police and has recent experience of cases involving allegations of misfeasance, malicious prosecution, unlawful detention and personal injury claims arising from police pursuits. He has also represented Police forces in inquests into deaths in Police custody and acts and advises in relation to civil applications for cash forfeiture, closure orders, ASBOs and SOPOs.
