Family

Rachael is a specialist family law practitioner. She regards negotiation as of great importance in getting the best result for her clients, owing to the substantial costs involved in matters proceeding to a final hearing. Where cases are unable to settle, Rachael is meticulous in her preparation and is a robust advocate. She is committed to providing a first-class service to solicitors, communicating the results of hearings promptly and providing clear and detailed attendance notes via email when unattended. Rachael is a Western Circuit pupil advocacy trainer and an approved pupil supervisor. She is Joint Chair of the Hampshire Family Justice Council Money and Property Committee. Rachael regularly delivers bespoke lectures to solicitors and at Chambers’ seminars and has been a guest speaker at a number of Hampshire and Dorset Resolution training events. Rachael is qualified to accept instructions from members of the public direct under the Public Access Scheme.

Money and Property

Rachael’s principal area of practice is in financial provision following divorce, dissolution and separation following cohabitation. She has a wealth of experience in dealing with complex cases involving privately owned companies, family businesses, land (including farming businesses), concealment of assets and pensions. Rachael is regularly instructed in cases involving inherited wealth, intervening third party interests, applications for variation and enforcement of orders. She has delivered seminars on the impact of bankruptcy and insolvency on consent orders and financial provision in general. Rachael undertakes cases involving disputes between cohabitees and co-owners (TOLATA), Inheritance Act claims, civil partnership dissolutions along with applications under Schedule 1 of the Children Act 1989. She also has experience of dealing with jurisdictional and other matters in relation to marriage and divorce. Rachael welcomes instructions in these areas at an early stage and is always happy to discuss the merits of a case initially by telephone or email.

Private Law Children

In private law applications, Rachael has considerable experience in representing clients when applications for residence and contact orders have been made, including special guardianship applications. She has acted in many cases where a guardian has been appointed to represent the child. Rachael has a particular focus on cases where domestic violence is a feature and regularly undertakes fact-finding hearings involving allegations of serious physical and sexual abuse. Rachael also has experience in cases involving abduction and removal from the jurisdiction. She began her practice prosecuting and defending in a wide range of cases in the Crown Court and Magistrates’ Court, alongside family law, and her experience of the preparation, procedure and advocacy involved in the criminal jurisdiction has proved invaluable.

Public Law Children

Rachael receives instructions to represent Local Authorities, parents and Children’s Guardians in applications for care and supervision orders. She also has experience of dealing with secure accommodation orders and education supervision orders. Rachael has dealt with many cases involving neglect, non-accidental injuries, alcohol/substance misuse and psychiatric disorders. Rachael has a clear grasp of the difficult and often sensitive issues involved in public law applications.

Interests

In her spare time, Rachael enjoys marathon running, snowboarding, travelling and cooking.
