Personal Injury & Clinical Negligence

Mark Sullivan acts for both Claimants and Defendants in all types of personal injury actions. He accepts instructions under Conditional Fee Agreements in appropriate cases.  He has particular experience in employer’s liability, road traffic and fatal accident claims. Examples of recent cases in which he has been instructed are set out below.

Employer’s liability

R v W Ltd. & C. Acted for Claimant under CFA in claim relating to injuries sustained in an accident in a farmyard from where he was collecting milk in a bulk carrier. Claim brought under Workplace Regulations and PUWER as well as employer’s common law duty.
H v PE Ltd. Acted for Claimant in complex claim brought under Manual Handling Regulations.
G v OAU. Acted for Claimant in claim brought under Construction and Working at Height Regulations.

Road Traffic

R v SB Ltd. Acted for Claimant in an accident involving a bus and a pedestrian where Claimant suffered severe brain damage. Liability disputed and reconstruction experts instructed by both sides.
B v W. Acted for Defendant in multiple car pile-up, advising on liability split. Also represented Defendant in related criminal proceedings.
In addition to acting in civil proceedings, he is frequently instructed by insurers to represent Defendants in related criminal proceedings for causing death by careless and/ or dangerous driving.

Fatal Accidents

G v K. Acted for Claimants in claim brought following death in a road accident of Kenyan national with dependants in Kenya and USA.
F v G. Acted for Claimants in claim following death of young mother. Advised on quantum and apportionment in relation to widow and 3 young children.

Other

C v C. Acted under CFA for semi-professional footballer badly injured as a result of dangerous tackle.
C v WG. Instructed by Claimant in relation to claim arising out of a food poisoning incident, leading to the development of chronic fatigue syndrome.
S v B. Instructed on behalf of Defendant in relation to allegations of sexual abuse. Issues included resisting application for a freezing order.

Prior to coming to the Bar, Mark Sullivan qualified as a Chartered Accountant and then worked for 14 years in international investment banking in London and New York. He has particular expertise in formulating and advising on complex loss of earnings and pension claims.
