Chris has acted in numerous diverse contractual disputes, including:
Odeyumi v Stagecoach Southwestern Trains Limited v Pakex (UK) Limited v Teknik Office Limited [2011]
Four party multi-day case arising out of personal injury caused by a chair collapsing. Whether product was defective or collapse of chair was caused by misuse or overuse. Interpretation of Sale of Goods Act 1979. Whether claim for indemnity or contribution included penal interest under Part 36.
Russell Racing Limited v DeGraaff Trailers Limited [2011]
Application for security for costs. Whether After the Event Insurance under a Conditional Fee Arrangement sufficient to obviate security for costs when personal guarantee also offered. Consideration of terms of ATE insurance contract. Michael Phillips Architects Ltd v Riklin and another [2010] EWHC 834 (TCC).
Chris is highly experienced in the field of credit hire, having acted for both Claimants and Defendants, and has successfully dealt with cases where liability is in dispute. He also has particular experience in the application of the Cancellation of Contracts made in a Consumer's Home or Place of Work etc Regulations 2008 (Doorstep Selling Regulations), and the enforceability of credit hire contracts against minors.
Taylor v Groupama Insurance [2011]
Impact of Consumer's Home or Place of Work etc Regulations 2008 on credit hire contract. Whether cancellation clause in credit hire contract was similar to a cancellable agreement under the Consumer Credit Act 1974, and the contract accordingly exempt under Regulation 6(1)(c).
Staff v TNT [2010]
Contested Liability. Whether oral contract had been agreed prior to signing, agreeing to Hirer’s standard terms and conditions.
Chris has acted for companies in the recovery of debts incurred under consumer credit contracts, including acting against litigants in person and claims advisors.
