Carl has a growing practice in construction matters advising and acting for employers, contractors and sub-contractors in litigation in the High Court and County Courts and ADR.
Recent work has included:
- Drafted proceedings on behalf of homeowners in a building claim valued at over £100,000 where there was very little documentation as to the agreement. The defendant was not a professional contractor and there were many variations. The homeowners alleged that the defendant fraudulently misrepresented that additional works were required by building control.
- Advised and drafted a defence, reply and additional claim in proceedings for recovery of sums due under oral agreements between contractors. The defence was based on agency, the agreements having been concluded on his brother’s behalf. Advised on and negotiated compromise of proceedings.
- Advised claimant as to construction of JCT contract providing for certification where there was no certifier.
- Advised claimant and defendant parties as to adjudication jurisdiction and acted in adjudication enforcement proceedings in the County and TCC.
- Acted for contractor in summary judgment application for action on dishounoured cheque. Also advised on merits of claim for recovery of debt in contract for the provision of retail fitting.
