3PB is able to offer a full service across the range of contemporary banking and financial services litigation. Chambers boasts a number of members who are fully versed in regulatory and disciplinary matters, ranging from winding up petitions brought by the regulatory authorities against companies thought to have breached the general prohibition to directors’ disqualification. There are members who have particular expertise in advising on questions relating to “land-banks”, money laundering and financial frauds.
David McIlroy is Visiting Senior Lecturer in Banking Law, SOAS, University of London, and Paul O’Doherty is a civil practitioner focusing on contractual and commercial disputes who, prior to coming to the Bar, spent five years as an investment banking analyst, working in corporate finance and private equity.
Members advise both on traditional areas of bank litigation such as guarantees, mortgages, cheques and undue influence, as well as on rapidly developing areas such as derivatives mis-selling claims and errors in the electronic processing of payments. Chambers can provide experts on consumer credit and factoring. In relation to smaller claims, members can guide clients through the process of making a complaint to the Financial Ombudsman Service.
Other areas of financial services litigation covered by Chambers include claims for negligent misstatement, misrepresentation and breach of contract arising out of financial advice or investments, as well as all areas of insurance law other than marine insurance and re-insurance.
